Proposal: In April 2018, the Joint President/Senate Inclusion & Respect Task Force presented its recommendations to the Senate and the President for review and approval. Among its recommendations, the Task Force suggested minor revisions to the Non-Discrimination Policy to clarify the jurisdiction of the policy given the new Policy on Threatening and Intimidating Conduct. The Task Force recommended that the University Senate should charge its Equity, Diversity, and Inclusion (EDI) Committee with a comprehensive review of the Non-Discrimination Policy & Procedures to consider whether broader changes were needed. The EDI Committee was charged with this review in fall 2018.

Decision: The committee's review of the policy was postponed until Fall 2020
Actions: In fall 2018, the EDI Committee worked with the Office of Diversity and Inclusion and the Office of Civil Rights and Sexual Misconduct to consider how the Non-Discrimination Policy and Procedures and the Policy on Threatening and Intimidating Conduct work in concert with each other. The committee also considered how each policy is interpreted by the campus community and issues related to implementation. It also conducted peer research and consulted with the Office of General Counsel.

In spring 2019, the committee drafted and refined its recommendations, which it reported and voted on at its March 12, 2019 meeting after sharing them with various stakeholders.

At its March 26, 2019 meeting, the EDI Committee learned that new federal regulations may affect the committee’s review of the policy and would likely require changes to definitions in other related policies in order to align them with the Non-Discrimination Policy. After reviewing each of these factors with the Office of Civil Rights and Sexual Misconduct, the Office of General Counsel, and the Office of the President, the EDI Committee agreed to delay its findings until the next academic year.

The new federal regulations did not come out until the end of the 2019-2020 academic year so the committee will continue its work on this charge in Fall 2020.

The new federal regulations resulted in revisions to the Sexual Misconduct Policy, which were approved on an interim basis pending Senate review on August 13, 2020. Those changes included a policy name change that needed to be updated in additional University policies. The updates to the name of the Sexual Misconduct Policy in the Non-Discrimination Policy were approved on an interim basis pending Senate review on August 13, 2020. The new interim policy will be charged to the EDI Committee under a new Senate Document# 20-21-04 so this bill will be closed.
Next Step: This bill will be closed and the EDI will continue its review of the Non-Discrimination Policy under Senate Document #20-21-04.
