Proposal: On March 5, 2010, the "University of Maryland Procedures for Review of Alleged Arbitrary and Capricious Grading -- Undergraduate Students" (Policy III-1.20(B)) was approved, updating the previously existing appeal policy III-1.20(A). This was formed originally as a result of the Board of Regents approval of the "Policy for Review of Alleged Arbitrary and Capricious Grading" (Policy III-1.20). The update does not include stipulations of timely response, notification, or justification on the part of the reviewing committee, which the original policy did in fact include. Anyone appealing a grade or involved in a grade appeal should not have to wait an excessively lengthy period of time to be informed of the decision by the reviewing committee.

Policy III-1.20(A) states the following in Section C, Subsection 2:

Clause d: "If the appeal is dismissed, the committee shall notify the student in writing within ten days of the decision, and include the reason or reasons for the dismissal."

Clause h: "The committee shall meet privately at the close of the fact-finding meeting to decide whether a majority believe the evidence supports the allegation of arbitrary and capricious grading beyond a reasonable doubt.
(i) The committee shall notify the student, the instructor, and the Dean in writing of the decision within five days of the meeting."

Timely notification, regardless of the decision by the review committee, should be specified in the policy so that students, instructors, the committee, and dean, are all clearly aware of how the process should will proceed and when a decision will be reached.

Additionally, in the event that an appeal is dismissed, the student and instructor should still be informed of both the decision and reason for dismissal. It should be made clear why such an appeal does not constitute arbitrary and capricious grading when such an appeal is dismissed administratively.

Update Policy III-1.20(B) to include the following under "Procedures:"

C: "Grade appeals may be dismissed administratively. In the event that an appeal is dismissed on administrative grounds, the student shall be notified within ten days of the dismissal and the reason(s) for the dismissal. The appeal may be dismissed administratively if:"

G -- 1 -- A: "The report shall be sent to the student and instructor within five days of the Chair receiving the report."
